Terms of Service

These Terms of Service (“Terms”) govern your use of ModernATC (“we,” “our,” the “Service”), operated by ModernATC, LLC, a South Carolina limited liability company. By creating an account or paying for a plan, you accept these Terms.

ModernATC is a study system for the FAA Academy curriculum and related Air Traffic Control material. We provide question banks, spaced-repetition scheduling, and timed practice tests. We are not affiliated with the Federal Aviation Administration. The Service does not certify, qualify, or guarantee any outcome at the FAA Academy or any FAA testing event.

You must be at least 17 years old to create an account. You are responsible for safeguarding your password and for any activity under your account. Notify us immediately at hello@modernatc.com if you suspect unauthorized access.

• Monthly and yearly subscriptions automatically renew at the end of each period at the then-current price unless cancelled before renewal.
• You may cancel any time from the Account page in the app. On monthly plans, cancellation takes effect at the end of the current billing period. On yearly plans, cancellation stops renewal but does not refund the current period.
• Refunds: Refunds are not guaranteed and are issued at our sole discretion. If you believe your situation warrants one, contact us at hello@modernatc.com and we’ll review your request. The Lifetime tier is no longer offered to new buyers; existing Lifetime licenses continue to receive all features at no further cost.
• We reserve the right to change pricing on a going-forward basis. Existing subscribers will be notified at least 30 days before any change takes effect on their plan.

You agree not to:

• Share your account or credentials with others.
• Resell, sublicense, or redistribute Service content.
• Scrape, mirror, or reverse-engineer the Service or its question bank.
• Upload content that is unlawful, infringing, or that you do not have rights to.
• Attempt to circumvent rate limits, RLS, or any security control.

We may suspend or terminate accounts that violate these rules, with or without notice, and without refund where the violation is material.

All authored content (questions, explanations, audio drills, UI, logos) is owned by ModernATC, LLC or its licensors and is protected by copyright. We grant you a non-exclusive, non-transferable, revocable license to access and use the Service for your personal study. FAA documents we cite (JO 7110.65, the Pilot/Controller Glossary, JO 7400.11, the AIM, and related orders) are works of the United States Government and are in the public domain (17 U.S.C. § 105).

The Service is provided for educational purposes only. Nothing in the Service constitutes operational ATC instruction, official FAA guidance, or a substitute for the FAA Academy curriculum, facility-specific training, or any examination administered by the FAA. Always defer to current official FAA publications and facility directives in operational use.

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that the content is current with the latest .65 change package on every given day.

To the maximum extent permitted by law, ModernATC, LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, or opportunities, arising out of or in connection with the Service. Our total cumulative liability for any claim arising under these Terms will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).

You agree to indemnify and hold ModernATC, LLC harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms, your content, or your use of the Service.

You may terminate your account at any time from the Account page. We may terminate or suspend access immediately, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Sections 6, 8, 9, 10, 12, and 13 survive termination.

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Charleston County, South Carolina, and you consent to personal jurisdiction there.

We may update these Terms from time to time. If a change is material, we will notify you by email or in-app at least 30 days before it takes effect. Continued use after the effective date constitutes acceptance.
